Our Commitment to CAN-SPAM Compliance

SendFlux Media takes email compliance seriously. All email campaigns we manage on behalf of clients are required to comply with the CAN-SPAM Act of 2003. This page outlines our standards and what we require of all clients.

What CAN-SPAM Requires

The CAN-SPAM Act sets rules for commercial email and gives recipients the right to opt out. Key requirements include:

  • Accurate "From," "To," and routing information — no deceptive headers
  • Non-deceptive subject lines that reflect the content of the email
  • Clear identification that the message is an advertisement, where applicable
  • A valid physical postal address included in every commercial email
  • A clear and easy opt-out mechanism in every email
  • Honoring opt-out requests within 10 business days
  • Monitoring what others do on your behalf — clients remain responsible for compliance even when outsourcing to SendFlux Media

Our Standards

Every campaign SendFlux Media manages will include:

  • A functioning one-click unsubscribe link
  • The client's valid physical mailing address in the footer
  • Honest subject lines approved by the client
  • Proper sender authentication (SPF, DKIM, DMARC)

Client Responsibilities

Our clients (agencies) are responsible for ensuring that:

  • All contact lists used in campaigns are lawfully obtained with appropriate consent
  • Unsubscribe requests from their end-clients' subscribers are processed promptly
  • A valid physical address is provided for use in email footers
  • Campaign content approved for sending is truthful and not misleading

SendFlux Media reserves the right to refuse to send campaigns that appear to violate CAN-SPAM or other applicable laws.

Opt-Out Handling

All campaigns include an unsubscribe link. When a recipient opts out, their suppression is applied within the email platform used for that client's campaigns. SendFlux Media will not send further marketing emails to suppressed contacts.

Reporting Violations

If you believe you have received an email from a SendFlux Media-managed campaign that violates CAN-SPAM, please contact us at [email protected] and we will investigate promptly.
