By engaging SendFlux Media for services, you ("Client") agree to these Terms of Service. These terms govern your use of our email marketing management services provided through sendfluxmedia.com.
SendFlux Media provides white-label email marketing campaign management on a monthly retainer basis. Specific deliverables are determined by the plan selected (Starter, Growth, or Scale) as described on our pricing page at the time of purchase.
Either party may cancel services with 30 days written notice sent to [email protected]. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued for unused days within a billing period.

All campaign copy, templates, and creative assets produced by SendFlux Media for a Client become the property of that Client upon full payment for the month in which they were created. SendFlux Media retains the right to use anonymized campaign performance data for internal benchmarking.
Both parties agree to keep confidential any proprietary or sensitive business information shared in the course of the engagement. SendFlux Media will not disclose client or end-client information to third parties without written consent.
SendFlux Media is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our liability in any circumstance is limited to the fees paid for the month in which the issue occurred. We do not guarantee specific open rates, click rates, or revenue outcomes, as email performance depends on factors outside our direct control including list quality and market conditions.
SendFlux Media operates in compliance with CAN-SPAM, GDPR, and other applicable email marketing regulations. Clients are responsible for ensuring their contact lists and marketing practices comply with applicable laws in their jurisdiction.
These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation before pursuing legal remedies.
